These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and VakilSOS (“VakilSOS”, “we”, “us”, “our”) governing your access to and use of the VakilSOS website, AI Legal Assistant, complaint drafter, search, Know Your Rights content and related services (collectively, the “Services”). By accessing or using the Services, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Services.
1. Nature of the Services
VakilSOS is a legal-information and legal-technology platform focused on India. It provides general legal information, AI-assisted issue triage, rights explainers, complaint drafting assistance and, on request, introductions to independent legal professionals. All legal authority surfaced by the Services is derived from a centralized legal registry built primarily around the Bharatiya Nyaya Sanhita, 2023 (BNS), the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) and the Bharatiya Sakshya Adhiniyam, 2023 (BSA), along with other Indian statutes and regulations relevant to the matter, with historical equivalents under the Indian Penal Code, 1860, Code of Criminal Procedure, 1973 and Indian Evidence Act, 1872 shown where useful.
VakilSOS is not a law firm, does not itself provide legal advice, does not represent you before any court, tribunal or authority, and use of the Services does not create an attorney-client relationship with VakilSOS or its personnel.
2. Eligibility
You must be at least 18 years old and legally competent to contract under Indian law to use the Services. If you access the Services on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
3. No Legal Advice; AI Limitations
The Services provide general legal information based on the facts you input and the statutes recorded in the centralized legal registry. Nothing on the Services constitutes legal advice tailored to your circumstances. AI-generated output may be incomplete, out of date or inaccurate in your specific context. You must independently verify any information before acting on it, and consult a qualified advocate enrolled under the Advocates Act, 1961 for any matter with legal consequences.
4. Acceptable Use
You agree to use the Services only for lawful purposes and to:
- Provide truthful, accurate information. Filing a false complaint or knowingly furnishing false information to a public servant is itself an offence under BNS §217 / §248 (historical: IPC §182 / §211) and similar provisions.
- Not use the Services for any unlawful, defamatory, harassing, obscene, threatening or fraudulent purpose.
- Not impersonate any person or misrepresent your relationship to another person.
- Not upload or transmit malware, exploit code or content that infringes any third-party right.
- Not scrape, crawl, mirror, reverse-engineer, bulk-download, jailbreak or otherwise misuse the Services or attempt to bypass technical restrictions.
- Not use the Services to build a competing product or to train a machine-learning model.
5. User-Generated Content
You retain ownership of the text, facts and documents you submit to the Services (“User Content”). By submitting User Content, you grant VakilSOS a limited, non-exclusive, royalty-free licence to process it solely to operate, secure and improve the Services in accordance with the Privacy Policy. You are solely responsible for the legality of your User Content and for keeping your own backups of anything important.
6. Intellectual Property
All content on the Services other than User Content and public-domain statutory material — including the VakilSOS name, logo, design, source code, prompts, classifiers, complaint templates, cards and copy — is owned by or licensed to VakilSOS and protected by Indian and international intellectual-property laws. Citations to Indian statutes belong to the public domain. You may use complaint drafts generated for you personally; you may not resell, repackage, redistribute or commercially exploit the Services or their outputs without our prior written consent.
7. Not an Emergency Service
The Services are not a substitute for emergency services. If you are in immediate danger, call 112 (Pan-India Emergency), 1091 (Women), 1098 (Child) or 1930 (Cyber Financial Fraud) before anything else.
8. Referrals to Legal Professionals
Where you request legal assistance, VakilSOS may facilitate an introduction to an independent, qualified legal professional. Any engagement, fee arrangement, retainer, professional obligations and advocate-client relationship arising from such an introduction are strictly between you and that professional and are governed by their own terms, the Advocates Act, 1961 and the Bar Council of India Rules. VakilSOS is not a party to that engagement, is not a marketplace or solicitation platform, does not guarantee any outcome, and does not share in professional fees.
9. Third-Party Services
The Services rely on third parties such as cloud hosting providers, database and authentication providers, AI model providers, WhatsApp Business (Meta Platforms) and official government portals. VakilSOS is not responsible for outages, content changes, policy changes or acts or omissions of those third parties.
10. Service Availability & Changes
We aim for high availability but do not guarantee that the Services will be uninterrupted, timely, secure or error-free. We may add, modify, suspend or discontinue any part of the Services at any time without notice.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, currency or completeness. VakilSOS does not warrant that any legal outcome will be achieved through use of the Services.
12. Limitation of Liability
To the maximum extent permitted by Indian law, VakilSOS, its founders, employees, contractors, service providers and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profits, loss of data, loss of goodwill, or losses arising out of any complaint, FIR, notice, proceeding, judgment or action initiated, drafted, filed or omitted based on the Services. Our aggregate liability for all claims arising out of or relating to the Services shall not exceed the amount you paid to VakilSOS in the twelve months preceding the event giving rise to the claim, and if you have paid nothing, shall not exceed INR 1,000.
13. Indemnity
You agree to indemnify and hold harmless VakilSOS and its personnel from and against any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your User Content, or (c) your violation of any applicable law or third-party right.
14. Suspension & Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or that your use poses a risk to other users or the platform.
15. Grievance Mechanism
In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the DPDPA, any concern regarding the Services or your personal data may be sent to our Grievance Officer at contact@vakilsos.in. We will acknowledge within 48 hours and respond within 30 days.
16. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to any non-derogable consumer protections available to you, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or relating to the Services or these Terms.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new “Last Updated” date and, where appropriate, communicated through the Services. Continued use after changes take effect constitutes acceptance of the revised Terms.
